Jewelry and precious metals are not automatically tested. This includes items that are stamped and hallmarked. Some items have been scanned in the Niton DXL. The readings have been noted, but this IS NOT A GUARANTEE. Personal inspection is always the best way for an individual to make the most informed bidding decisions. Precious stones are not tested or removed from mountings to determine carat. Appraisals are attached for some items. THIS IS ALSO IN NO WAY A GUARANTEE. An appraisal is based on one professional's opinion. WE SPECIFICALLY DISCLAIM ANY AND ALL EXPRESSED AND OR IMPLIED WARRANTIES OF MERCHANTABILITY WITH REGARD TO ANY SALE MADE THROUGH APPLE TREE AUCTION CENTER. We recommend prospective bidders examine all items in which they have an interest or contact us prior to bidding for a condition report or to express concerns with the description. By placing a bid, either in person, by phone, absentee or via the Internet, you signify that you have examined the items as fully as you desire to or that you have chosen not to examine them. If you require absolute certainty in all areas of authenticity, and the results of your evaluation leave uncertainty in your mind, we recommend you have an expert examine the lot for you or do not bid on the item in question. We do not give refunds or price adjustments. All sales are final!
Payment
All purchases are subject to a 20% buyer's premium discounted to 15% for cash, check, or wire transfer.
All items purchased in person must be paid for within 24 hours of the day of the auction. All items purchased through absentee, phone bidding, or online; an invoice will be emailed to you within 3 days from the date of the sale. 48 hours after the invoices have been emailed, the credit card on file will be automatically charged unless you have contacted us to arrange an alternative payment method. If you plan to pay by check, please email [email protected] immediately after receiving your invoice so we can prevent your card on file from being automatically charged. Failure to make payment arrangements within 7 days following the auction will result in a NPB being placed on your account. For auctions listed as "next day pick up only" auctions, all items must be paid for by the end of the next business day or the card on file will be charged.
Acceptable forms of payment - Invoices less than $10,000 may be paid through wire transfer, cash, check, Visa, MasterCard, Discover, or AmEx. Merchandise will be released once payment is received. All purchases will be subject to a 7.25% Ohio sales tax unless the purchaser possesses a valid tax-exempt number. Invoices shipped out of state are not subject to Ohio sales tax. Apple Tree Auction must have a blanket exemption certificate with permit number and signature on any tax-exempt sale except for out of state internet bidders.
If we are prevented by fire, theft, or any other reason whatsoever from delivering any property to the purchaser, our liability shall be limited to the sum actually paid, by the purchaser for such property.
If any applicable conditions herein are not complied with by the purchaser, Apple Tree Auction at its option may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser or (b) resell the property at public auction without reserve or minimum selling price, and the purchaser will be liable for any deficiency and costs, including handling charges, expenses of both sales, the commission on both sales at regular rates, all other charges due hereunder and incidental damages.
Apple Tree Auction reserves the right to withdraw any lot at any time before the auction without liability.
Bidding In Person, Absentee, Online, Telephone
The successful bidder is the highest bidder acknowledged by the auctioneer. In the event of any dispute between bidders, or in the event of doubt on Apple Tree Auction's part as to the validity of any bid, the auctioneer will have the final discretion either to determine the successful bidder or to re-offer and resell the article in dispute. Occasionally a clerical/human error is made, and we are unable to remedy. If any dispute arises after the sale, Apple Tree Auction's sale record is conclusive.
As a convenience to customers, absentee bids and phone bids will be executed by Apple Tree Auction personnel in a fair, competitive and confidential manner. Phone bid arrangements must be made 24 hours prior to start of the auction. Apple Tree Auction will not be responsible for failure to execute absentee or phone bids. Phone bids have a minimum opening of $500.
No international bidding. Pre-approval is required for all bid limits over $3,000. We recommend you begin this process before the auction. Bank letters and other forms of proof may be requested. Bidding approval and bid limit increases may not be possible on the day of the auction. Please allow 24 hours.
The purchaser assumes full responsibility for items at the fall of the hammer. Any property remaining on Apple Tree Auction Center's premises more than five (5) days after purchase will be subject to a five-dollar ($5.00) fee per day, per item. Buyer's property remaining on the premises more than seven (7) days after the auction will be considered abandoned and will then become the property of the Auctioneer. For auctions listed as "next day pick up only" auctions, any items not picked up the day following the next day pick up auction will be considered abandoned and no refunds will be given.
Apple Tree Auction Center reserves the right to dispose of, sell, or otherwise distribute these goods without notification or dispute to/from the Buyer.
U.S. Coins and currency require a minimum bid of 20% over face value.
The auctioneer reserves the right to reject any bid not commensurate with the value of the property offered.
Shipping
At the close of the auction, you should receive a text and/or email from Shipping Saint, our shipping management system. The message includes a link asking: "What do you want us to do with your item(s)?" If you choose shipping, you're all set! Once your items are packed, you'll receive a follow-up email or text to confirm your shipping address and pay your shipping invoice. Shipping typically takes 3-5 business days after payment is received. If you choose pickup, you'll be prompted to select a pickup date and time. Be sure to bring someone to help you load your items, as we do not have staff available for loading assistance. Need the link again? Simply reply to your original email or call us at 740-344-4282. If an item is too large or too fragile for us to do in-house we use a third-party shipper. We work closely with UPS Store #3910 to address these third-party shipping needs. You can either call them yourself or just let us know and we will organize pick up of your item(s) and they will contact you once they're ready to ship.
